1. Introduction

These Terms of Use (“Terms”) govern your access to and use of any product, software, application, service, website, API, or feature provided under the MintFlow brand (collectively, the “Services”), operated by MintFlow Technologies, Italy-based entity.

By using any MintFlow Services, you agree to these Terms. If you do not agree, do not use MintFlow Services.

2. Eligibility

You must be at least 16 years old to use MintFlow Services.

By using the Services, you represent that you meet this requirement.

3. Scope of Services

MintFlow may provide, including but not limited to:

  • Desktop applications
  • Mobile applications
  • Web applications
  • AI-powered agents (e.g., MintAgent)
  • File management and snapshot systems
  • Journaling and note-taking tools
  • Monitoring and productivity tools
  • APIs and integrations with third-party services

Some features may require installation, local system access, or external API keys.

4. User Accounts

Some Services require a MintFlow account.

You agree to:

  • Provide accurate information
  • Maintain the confidentiality of your credentials
  • Accept responsibility for any activity under your account

MintFlow is not liable for unauthorized account access caused by your failure to secure credentials.

5. User Content & Ownership

You retain full ownership of any content you create, upload, process, or store using MintFlow Services (“User Content”).

MintFlow Technologies:

  • Does not claim ownership over User Content
  • Does not use your content for marketing, training, or redistribution
  • Does not monitor or read your private content unless legally required

You grant MintFlow a limited, technical, non-exclusive license to process your content solely for the purpose of providing the Services.

6. Local-First Architecture

By default, MintFlow products are designed to operate locally on your device.

With the exception of account authentication data, MintFlow does not transfer, collect, or store your data on external servers unless explicitly enabled by you.

7. Third-Party AI Services

Some MintFlow products allow or require the use of external AI services (including but not limited to Google Gemini, OpenAI, or similar), using your personal API keys.

MintFlow Technologies:

  • Does not provide or manage these keys
  • Does not control how external providers handle your data
  • Is not responsible for third-party services or data processing by them

Your use of third-party AI services is governed by their respective policies.

8. Prohibited Uses

You agree not to use MintFlow Services for:

  • Illegal activity under EU or international law
  • Hacking, unauthorized access, or surveillance
  • Creation or distribution of malware
  • Harassment, threats, or illegal tracking
  • Circumventing security systems
  • Any action that violates applicable law

MintFlow reserves the right to restrict or suspend access if illegal use is suspected.

9. System Automation & User Responsibility

Some MintFlow tools may be capable of performing automated system actions.

You acknowledge that:

  • Any automated action is executed under your authorization
  • You are fully responsible for the consequences of such actions
  • MintFlow Technologies is not liable for data loss, system damage, or unintended actions resulting from automation processes

Use at your own risk.

10. Open Source Components

Certain applications or modules may be released as open-source under separate licenses.

These components remain governed by their respective license terms.

MintFlow Technologies retains proprietary rights over any non-open-source components and branding.

11. Reverse Engineering & Unauthorized Use

You agree not to, and shall not attempt to:

  • Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of any proprietary MintFlow software
  • Modify, translate, adapt, or create derivative works based on the Services
  • Circumvent or bypass any security, license, or technical protection mechanisms
  • Access or use the Services in any manner not explicitly authorized by MintFlow Technologies

This restriction does not apply to components that have been explicitly released as open-source, which remain governed by their own licenses.

Any violation of this section may result in immediate termination of access and potential legal action.

12. Termination

You may stop using the Services at any time.

MintFlow may suspend or terminate access only:

  • For illegal use
  • For system security
  • For severe abuse

User data deletion requests will be honored as stated in the Privacy Policy.

13. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind.

MintFlow Technologies explicitly disclaims all warranties, including:

  • Fitness for a particular purpose
  • Accuracy of outputs
  • Availability
  • Error-free operation

14. Limitation of Liability

To the maximum extent permitted by law, MintFlow Technologies shall not be liable for any:

  • Direct damages
  • Indirect damages
  • Incidental damages
  • Loss of data
  • Loss of profits
  • System or device damage

Resulting from the use or inability to use the Services.

15. Governing Law

These Terms are governed by the laws of the European Union, with reference jurisdiction in Italy.

PRIVACY POLICY

MintFlow Technologies respects your privacy and is committed to protecting your personal data in compliance with GDPR and EU privacy regulations.

2. Data We Collect

We may collect the following account-related data:

  • Name (optional)
  • Email address
  • Encrypted password

We do not collect by default:

  • Files
  • Notes
  • System content
  • Audio, images, or documents
  • Location data
  • Personal files
  • AI prompts (unless you opt in)

3. Local Data Storage

MintFlow products store all project data locally on your device by default.

MintFlow does not access, view, or transfer personal files from your system.

4. AI Features

Some apps may use external AI services (e.g., Google Gemini), but only when:

  • You provide your own API key
  • You manually enable the integration

MintFlow is not responsible for data processing or storage by third-party providers.

5. Cookies

MintFlow uses essential cookies only, required for:

  • Login sessions
  • Security
  • Application stability

We do not use:

  • Tracking cookies
  • Profiling cookies
  • Advertising cookies

6. User Rights (GDPR)

You have the right to:

  • Request your data
  • Correct your data
  • Delete your data (“right to be forgotten”)
  • Withdraw consent

7. Data Retention

Account data is stored only as long as necessary for your account to function, or until deletion is requested.

MintFlow products, including MintAgent and related automation tools, may generate content or perform actions based on user instructions.

You understand and agree that:

  • All outputs may be incorrect or incomplete
  • MintFlow provides no guarantee of accuracy
  • MintFlow is not a substitute for legal, financial, or medical advice
  • You are responsible for verifying all actions and results
  • MintFlow Technologies is not liable for harm, loss, or legal issues caused by usage
